Commitment to Privacy

Factual Data is committed to respecting the privacy of consumers. This notice provides more information on our data privacy practices, including how we collect, use, disclose, store and otherwise process personal information in the course of providing services to our customers, including when we resell consumer reports obtained from consumer reporting agencies to our customers. This notice also describes how consumers can access their consumer report and correct or delete inaccurate or incomplete information in their consumer report. This privacy notice is informational only and is not a contract, nor does it create any legal rights or obligations.


How We Obtain Personal Information

Personal information, as used in this notice, means any information that relates to or can be used to identify an individual person, including name, address, date of birth, telephone number, and Social Security number. In the course of business, our customers provide certain personal information to us in order to obtain our services, as allowed by applicable credit reporting and data privacy laws. As a reseller of consumer reports, Factual Data does not maintain its own database of personal information from which new reports are created. Instead, we obtain personal information, including consumer reports, from third-party sources and deliver this information to our customers.


How We Use Personal Information

In addition to obtaining and reselling consumer reports to our customers, Factual Data uses personal information to support other business functions, such as maintaining data integrity and accuracy and for fraud prevention, information security, legal support, and statistical analysis. We also access personal information when contacted by consumers in order to authenticate and assist consumers regarding their consumer reports.


Disclosure of Personal Information to Third Parties

Information that Factual Data receives from its customers or data vendors may be sent to our affiliates, subcontractors, or technology and data vendors that assist us in providing services.

Factual Data sells consumer report information to businesses and other customers who have a permissible purpose under applicable credit reporting and data privacy laws to receive this information.


Disclosure of Personal Information for Legal and Safety Reasons

Factual Data may be required to disclose personal information to regulatory agencies, law enforcement agencies, government authorities and agencies and others. We may disclose information as required by law, in the course of litigation, as a matter of national security, to comply with valid legal processes, including subpoenas, court orders, or search warrants, and as otherwise authorized by law. We may also need to disclose personal information in the event of an emergency that threatens an individual's life, health, or security.


Security Measures to Protect Personal Information

We are committed to protecting the confidentiality and security of your personal information and use a variety of security measures, technologies, and procedures to help protect your personal information from unauthorized access, use, or disclosure. These measures include, among other things, administrative, technical, and physical controls and safeguards. Although no data transmission or storage can be guaranteed to be 100% secure, we maintain an information security program that includes safeguards to protect the confidentiality and security of personal information from unauthorized access, use or disclosure in accordance with applicable credit reporting and data privacy laws. We have also taken steps to ensure that access to personal information is limited to necessary employees and third parties.


Retention of Data and Disposal of Personal Information

Factual Data retains personal information for as long as necessary for business purposes and to provide services to our customers. At the end of its retention lifecycle, personal information is destroyed or otherwise rendered inaccessible. Factual Data takes reasonable measures to protect against unauthorized access to or use of personal information in connection with its disposal of such information.


Accuracy of Consumer Reports

Factual Data follows reasonable procedures to ensure the accuracy of information in consumer reports, as required under Section 607(b) of the Fair Credit Reporting Act (FCRA).


Consumer Access and Correction Rights

Consumers can contact us to request a copy of the consumer report previously provided to a Factual Data customer. In order to protect the privacy of consumers, we require that consumers provide proper identification prior to disclosing consumer report information.

Under Section 611 of the FCRA, a consumer has the right to dispute inaccurate or incomplete information in a consumer report. As a reseller of consumer reports, we review the dispute to determine whether the inaccuracy is a result of Factual Data’s report or a result of the information from the consumer reporting agencies. If the inaccuracy stems from Factual Data’s merged report, we will correct or delete the inaccurate information. If the inaccuracy comes from information provided by consumer reporting agencies, Factual Data will convey your dispute to those consumer reporting agencies for further investigation. When the consumer reporting agency notifies Factual Data of the results of their investigation, we will convey the information to you.


Opt Out of Prescreening

Under Section 604(c) of the FCRA, Factual Data may resell consumer reports in connection with any credit or insurance transaction that is not initiated by the consumer if the transaction consists of a firm offer of credit or insurance. This is known as prescreening. Section 604(e) of the FCRA gives consumers the right to opt out of prescreening. Consumers can opt out at www.optoutprescreen.com. The opt-out request is sent to Equifax, Experian, Innovis, and TransUnion. If a consumer opted out and would later like to opt in, the consumer can request to opt in at www.optoutprescreen.com.


Children's Policy

This website is not designed for children. Factual Data does not knowingly collect information on children under the age of 13.


International Residents

This website is not targeted to international residents.


Changes to this Notice

We may periodically make changes to this notice. If we make changes to this notice, we will post the revised notice and its effective date on this website. We encourage you to check back to our website to review the current version of this notice so you will always know how we collect, use, and share your personal information.
