Factual Data is a reseller of consumer reports. A “reseller” is a consumer reporting agency that (1) assembles and merges information contained in the database of another consumer reporting agency or multiple consumer reporting agencies concerning any consumer for the purposes of furnishing such information to any third party, to the extent of such activities, and (2) does not maintain a database of the assembled or merged information from which new consumer reports are produced. As such, we may not have information on a particular individual solely because we are a reseller.

No. The state consumer privacy laws in effect as of October 23, 2023, including the California Consumer Privacy Act (CCPA), Virginia Consumer Data Protection Act, Colorado Privacy Act, and Connecticut Data Privacy Act, generally exempt activities that are subject to the Fair Credit Reporting Act and personal information subject to the Gramm-Leach Bliley Act from the data access and deletion rights requests and other provisions under those laws.

If you submitted a loan application to a bank, mortgage company, or other lending institution that used our services to obtain a consumer report on you to assist them in processing your application, you should submit your request to delete your personal information collected by your lender or exercise your other rights under the CCPA or other state privacy laws to your lender.

If you are a California resident and a current employee of Factual Data, you may also submit a request to us through the channels disclosed in our Employment Privacy Statement or other employment policies.

No. Factual Data is a consumer reporting agency that provides consumer report information to its customers as permitted under the Fair Credit Reporting Act and identification information to its customers under the Gramm-Leach Bliley Act. Factual Data receives this information from other consumer reporting agencies and provides this information to its customers, such as banks, mortgage companies, and other lenders, who use this information to evaluate their credit applicants or customers.

We cannot process requests to delete or erase your personal information in a consumer report or in an identification information product that we previously provided to a Factual Data customer.
